1. Scope
1.1 These Terms and Conditions apply to all contracts that you as a customer conclude via the online shop photobooth-kaufen.eu with fexon e.K., owner Christian Fischer, An der Eisbahn 8, 07973 Greiz, Germany (hereinafter “we” or “seller”). The version valid at the time of the order applies.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). A business customer (entrepreneur) is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade, business or profession when concluding the legal transaction (Section 14 BGB). If you select the customer type “company” during the order process, we treat you as a business customer.
1.3 We do not accept deviating terms of the customer unless we expressly agree to them in writing.
1.4 You can reach our customer service for questions, complaints and claims by telephone on +49 3661 4555881 and by e-mail at info@fexon.de.
2. Offers and product descriptions
2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to you to place an order. Product descriptions on our product pages do not constitute a warranty or guarantee.
2.2 Our photo booths are offered in various configurations. Which components (housing, computer, screen, camera, flash, printer, software, transport case) are included in the respective price follows from the “scope of delivery” on the product page and from the equipment you selected in the configurator. Housings “without electronics” contain no computer, camera, printer or software components.
2.3 All offers are valid while stocks last unless stated otherwise for the product. Errors excepted.
3. Ordering process and conclusion of contract
3.1 You may select products from our range without obligation, configure them and collect them in a basket via the button “Add to basket”. In the basket you can change or delete the selection at any time.
3.2 Via the button “Checkout” you enter your billing and delivery address, if applicable company name and VAT identification number, and the desired payment method. Before submitting the order, all order data are displayed in an overview where you can correct input errors.
3.3 By clicking the button “Order with obligation to pay” you submit a binding offer to conclude a purchase contract for the goods in the basket. Immediately afterwards you receive an automatic e-mail confirming receipt of your order (acknowledgement of receipt). This acknowledgement does not yet constitute acceptance of your offer.
3.4 The purchase contract is concluded when we accept your offer. Acceptance takes place by a separate order confirmation by e-mail, by sending the invoice, by the dispatch confirmation or by delivery of the goods, whichever occurs first. For payment by PayPal, credit card, Apple Pay, Google Pay or Klarna, we also accept your offer by initiating the payment process in the payment provider’s window. If we do not accept your offer within five working days, you are no longer bound by it; payments already made are refunded without delay.
3.5 The contract text (order data and these Terms) is stored by us and sent to you by e-mail with the acknowledgement of receipt. The contract language is German; this English version is provided for information, and in case of doubt the German version prevails.
4. Prices and shipping costs
4.1 The prices stated on the product pages are final prices and include the statutory VAT, which depends on the delivery country. Our prices are based on fixed net prices to which the VAT applicable in the delivery country is added; the shop shows the gross price for the selected delivery country. A switch allows net or gross prices to be displayed.
4.2 Deliveries to business customers in other EU member states with a valid VAT identification number and deliveries to Switzerland are invoiced without German VAT as intra-Community supplies or export supplies respectively. The validity of the VAT identification number is checked automatically during the order process. For deliveries to Switzerland the customer bears import VAT, customs duties and fees collected by the delivery service.
4.3 Shipping costs are charged in addition to the prices and depend on the delivery country and the shipping method (parcel or freight forwarder). Shipping costs are shown in the basket and in the order summary before the order is submitted; an overview is on the page Shipping and delivery.
5. Payment
5.1 We offer the following payment methods: credit card, Apple Pay, Google Pay and Klarna (each via the payment provider Stripe), PayPal including PayPal Pay in Instalments, and prepayment by bank transfer. The order process shows which payment methods are available in the individual case. Details are on the page Payment methods.
5.2 With prepayment you transfer the invoice amount within seven days of receiving the acknowledgement of receipt to the account stated there. The delivery period starts on receipt of payment. If payment is not received within 14 days, we may withdraw from the contract.
5.3 For payment via Stripe or PayPal the purchase price is due and charged on completion of the payment process. For PayPal Pay in Instalments you conclude a separate contract with PayPal (Europe) S.à r.l. et Cie, S.C.A.; whether and on which terms instalments are offered to you is decided by PayPal. We receive the full purchase price from PayPal. For Klarna, the terms shown by Klarna during the payment process apply.
5.4 If you are in default of payment, we are entitled to charge statutory default interest: for consumers five percentage points, for business customers nine percentage points above the base rate. We reserve the right to claim further damages caused by default.
5.5 You are entitled to a right of retention or set-off only if your counterclaim is based on the same contractual relationship or is undisputed or has been established by a final court decision.
6. Delivery, delivery time, passing of risk
6.1 We deliver to delivery addresses in Germany, Austria, Switzerland, Italy, France, the Netherlands and the Czech Republic. We do not offer deliveries to other countries in the online shop; please contact us if required.
6.2 Accessories, printers, consumables and transport cases are sent as parcels. Photo booth systems are sent on a pallet by freight forwarder. Freight is delivered to the kerbside of the delivery address and not carried into the building. The forwarder arranges the delivery date with you by telephone, for which we need your telephone number. If an order contains parcel and freight goods, the freight shipping method applies to the entire order.
6.3 Unless otherwise stated on the product page, the delivery time for photo booth systems without branding and without special colour is 5 to 10 working days, for accessories, printers and consumables 1 to 3 working days. The period starts on receipt of payment for prepayment and on conclusion of the contract for all other payment methods. For custom-made items (Section 7) we agree the delivery time individually; it depends on the approval of your print data.
6.4 We are entitled to make partial deliveries where this is reasonable for you; you incur no additional shipping costs as a result.
6.5 For consumers, the risk of accidental loss and accidental deterioration of the goods passes on handover to the consumer or a person designated by them. For business customers, the risk passes on handover of the goods to the carrier.
6.6 If delivery is permanently impossible due to force majeure (for example natural disasters, war, official orders, supply shortages of components such as cameras, computers or printers for which we are not responsible), we are released from our obligation to perform and refund payments already made without delay. In the event of temporary obstacles, the delivery time is extended by the duration of the obstacle; if it lasts longer than six weeks, both parties may withdraw from the contract.
7. Custom-made items (custom colour, branding)
7.1 Photo booths in a custom RAL colour and photo booths with individual foil wrapping or printing (branding) are manufactured to your specifications. You provide the specifications (RAL number or print data based on our templates) during or after the order. We begin production only after you have approved the print data.
7.2 For consumers there is no right of withdrawal for custom-made items under Section 7.1 (Section 312g (2) No. 1 BGB); we point this out in the configurator before selection.
7.3 You are responsible for errors in the print data you supply (resolution, colour space, spelling, missing rights of use in images and trade marks). You warrant that you hold the necessary rights in the content you submit and indemnify us against third-party claims.
8. Software and licences
8.1 Where a photo booth system is supplied with the dslrBooth Professional software (Lumasoft) according to the scope of delivery, you receive a licence from the software developer. Use is governed by the developer’s licence terms (EULA), which are displayed during installation or activation. The scope of the licence corresponds to the information on the product page; to our knowledge the licence is permanent, may be activated on two computers and includes program updates for one year from activation. After that the installed version continues to run; an update subscription can be taken out with the developer.
8.2 We are not the manufacturer of the software and give no guarantee beyond the statutory warranty for its functions, further development or the availability of the developer’s online services (for example online albums, sharing services). Changes by the developer to the range of functions or the name of the software do not affect the purchase contract.
8.3 We send you the licence data (licence key, access e-mail) by e-mail. You are obliged to keep these data confidential.
9. Retention of title
9.1 The delivered goods remain our property until the purchase price has been paid in full.
9.2 The following additionally applies to business customers: the goods remain our property until all claims from the business relationship have been settled. The business customer may rent out and resell the goods in the ordinary course of business; it hereby assigns to us the resulting claims up to the invoice value. Pledging or transfer by way of security is not permitted. The business customer must notify us immediately of any third-party access to the reserved goods.
10. Warranty (liability for defects)
10.1 Consumers are entitled to the statutory warranty rights. The limitation period for claims for defects is two years from delivery of the goods.
10.2 For business customers the limitation period for claims for defects is one year from delivery of the goods; this does not apply to claims for damages due to injury to life, body or health, in cases of intent or gross negligence, or fraudulent concealment of a defect. Business customers must inspect the goods immediately after delivery and notify us in writing of obvious defects immediately and of hidden defects immediately after discovery (Section 377 of the German Commercial Code, HGB); otherwise the goods are deemed approved. For business customers, subsequent performance is at our discretion by repair or replacement.
10.3 Please note externally visible transport damage to the packaging or to freight goods on the carrier’s delivery note at acceptance and inform us immediately. This facilitates settlement with the carrier; your statutory rights remain unaffected.
10.4 There is no defect in the case of damage caused by improper use, transport without suitable packaging, interference with electronics or cabling, operation outside the conditions stated in the assembly guide, moisture, voltage fluctuations or components not supplied by us. Wear parts such as print media and batteries are not subject to warranty insofar as they are consumed as intended.
10.5 Additional manufacturer guarantees may exist for components of other manufacturers (for example cameras, printers, computers, tablets); they are governed by the respective guarantee terms and do not limit your statutory rights against us.
10.6 To process a warranty claim please give us the order number, model and a description of the defect; we will tell you whether an on-site repair, the replacement of a component or a return is required. Please back up your data (photos, layouts, licence information) before returning; we accept no liability for data loss unless we are at fault.
11. Liability
11.1 We are liable without limitation for damage resulting from injury to life, body or health, in cases of intent and gross negligence, fraudulent concealment of a defect, assumption of a guarantee, and under the German Product Liability Act.
11.2 In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical of the contract. Otherwise liability for slight negligence is excluded.
11.3 The above limitations also apply to the personal liability of our legal representatives, employees and agents.
11.4 For lost profit, in particular cancelled rentals or events, we are liable to business customers only in the cases of Section 11.1.
12. Right of withdrawal for consumers
12.1 Consumers have a statutory right of withdrawal. The details, the grounds for exclusion (in particular for custom-made items under Section 7) and the model withdrawal form are in our notice of withdrawal. You can also declare withdrawal via the page Withdraw from contract.
12.2 Business customers have no right of withdrawal.
13. Returns
13.1 For returns please use the original packaging or the transport case where possible and an insured shipping method with tracking. Photo booth systems are freight goods; on request we organise the return against reimbursement of the actual costs, the amount of which is stated in the notice of withdrawal.
13.2 Before returning, please remove your own data from the booth computer and enclose the supplied accessories.
14. Data protection
Information on the processing of your personal data is in our privacy statement.
15. Dispute resolution
The European Commission discontinued its platform for online dispute resolution (ODR platform) on 20 July 2025. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
16. Applicable law, place of jurisdiction
16.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.
16.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office in Greiz.
17. Final provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
